The protection of your data is very important to us, which is why this website stores and processes data exclusively in accordance with the Austrian Data Protection Act and the European General Data Protection Regulation (GDPR). The use of this website is possible without providing personal data. We only collect your data (name, surname, telephone number and email address) if you voluntarily provide them via the contact form. Data generated as you browse our website

By normal browsing of our website - meaning without sending us a message via our contact form or by sending us an email - we log the following data, which your browser sends to our server in a so called "server-logfile".

During that we log the following anonymised data which are for us technically required to present you our website:

  • the visited website
  • date and time at the moment of access
  • sent amount of data in byte
  • referral from where you came to our website
  • used operating system
  • used browser
  • your IP address - anonymised

The processing of this data underlies our reasonable interest to improve stability and functionality of our website.

Contact form

If you use the contact form to get in touch with us, your data will be stored until we completely processed your request, but in no case your data will be passed on to third parties without your explicit consent. The data will be deleted at latest 6 months after receiving.

Application data

Your application details (contact details and application documents) will be stored for the purpose of processing your application and will in no case be passed on to third parties without your consent. At the latest 6 months after receiving your transferred data are deleted, unless you explicitly wish otherwise.

Deletion of your data

We store your data for the fulfillment of your request and for the case of follow-up questions, six months.

Futhermore we save your data which we collected according to contracts we closed with you, until your withdrawal or as long as we are obligated by law – retention requirement in accordance to §132 BAO (basically 7 years after the last document has been issued).

Newsletter Content

We use our newsletter to inform our newsletter subscribers about news concerning our brand KATE & TOM, special events, activities and events in our restaurants, as well as recipes and hints on the topic wellbeing.

To subscribe to our newsletter it is only required to state a valid email address.

We explicitly point out that the subscription to the newsletter is at the same time also the consent to the newsletter analysis (described below).

Erasure of the entry in the newsletter list

To prove that consent for receiving the newsletter was given to us, we point out our right to store unsubscribed email addresses up to three years until we finally delete them. The basis for this is the following national regulation: "Gesamte Rechtsvorschrift für Standard- und Muster-Verordnung 2004, Fassung vom 24.05.2018", Anlage 1, SA022: Kundenbetreuung und Marketing für eigene Zwecke.

An erasure in advance is possible at any time, insofar we likewise get the confirmation that a former consent for the subscription to our newsletter is confirmed.

The email address of our newsletter subscribers, as well as the following described data (e.g.: device information, IP address, operating system, browser ID, date and time, etc.) are stored on the servers (in the USA) of the newsletter service provider.

The newsletter service provider is certified by the EU-US-Privacy Shield Framework. Thereby the newsletter service provider commits himself to comply with the data protection requirements of the EU. Accessible here: Privacy Shield Certificate

The newsletter service provider acts on our behalf in transmission and evaluation (further described in: Newsletter analysis) of our newsletter.

Furthermore the newsletter service provider (according to the company's own information) can use the collected data to optimize/improve its own service (e.g.: technical transmission optimization, presentation of the newsletter, etc.).

Double Opt-In

After you have subscribed to our newsletter, you receive at first an email which asks you to confirm your email address and after clicking the confirmation link you are validly subscribed to our newsletter mailing list. This measure is taken to ensure that an unknown person can't subscribe you to our newsletter without your personal consent. In the course of the sign-up process our newsletter service provider stores the date and time of the subscription, your email address, as well as your IP address.

Possible changes of your information will be stored and logged by the newsletter service provider electronically.

Newsletter analysis

The newsletter service provider uses so called "web beacon" image files – which are invisible/imperceptible image files, that will be downloaded (as long as "show images" is activated in your mail client software) from the server of the newsletter service provider. By downloading this "web beacon" the newsletter service provider gets different data (e.g.: browser software, IP address, date and time, etc.), which he collects and stores. This information will also be used by the newsletter service provider to make technical improvements.

It is stored if and when the newsletter was opened. Furthermore which links were clicked. Because of the technical conditions, this information can be assigned to the different newsletter subscribers. However, it is certainly not our interest, or the interest of our newsletter service provider, to specifically analyse/observe individual users of our newsletter. But rather we use the whole range of gained data to identify the reading interests of our newsletter subscribers to thereupon being able to adjust our newsletter content to their interests.

The subscription without the newsletter analysis is not possible. If this is not wished for the newsletter subscriber has to cancel the newsletter subscription – read therefore the following section.
